On Friday, Nov. 12, the Sussex County Planning & Zoning Commission was hit with a lawsuit filed in Delaware Superior Court by the Washington, D.C.-based nonprofit organization Food & Water Watch. The suit, also filed on behalf of a local resident, claims the zoning decision regarding CleanBay Renewables’ “planned factory farm” biogas facility in Georgetown was unlawful.

In a statement to Delmarva Now, Thomas Spangler, executive chairman of CleanBay Renewables, noted they remain optimistic about the development. “We always support our elected officials listening to the public. For this matter particularly, Food & Water Watch’s concerns have been heard and reviewed multiple times. Each time, various levels of Sussex County government have denied their claims and approved our use for the site. We are excited about the future for this partnership between CleanBay, Sussex County, and local community stakeholders,” Spangler said in a statement.
